Welcome to TOP FASHION terms and conditions, which apply to all items ordered from topfashionmalaysia.com.my.

Please read though them carefully before placing your order. By using this website and/ or placing an order you agree to be bound by the terms and conditions set out below.

We may change these terms and conditions from time to time without any notice to you. Changes will apply to any subsequent orders received. Once your order has been confirmed, we will not be able to make any changes to the terms that apply to that order.

PRICE

All price are in Ringgit Malaysia (RM).


PAYMENT

When you order online, payment can be made with any major credit card or direct bank transfer during check out. Please make sure that your shipping address is correct.

Your credit card will be billed in Ringgit Malaysia and your statement will show your purchase as "KOMTAR TOP FASHION SDN BHD".

DELIVERY & SHIPPING

  • Delivery will be shipped via Pos Laju on all Malaysia orders.

  • FREE SHIPPING only valid to address anywhere in Malaysia.

While we do everything we can to ensure your order is delivered in a timely manner, we will not be liable for any loss or damage incurred by any person as a result of delay caused by our carrier that we have no control over or by any event which is out of our reasonable control or foresight including but not limited to any delay caused by an incorrect delivery address being provided to us.

Please note that orders cannot be delivered to Post Office boxes. After you have successfully placed your order, our Customer Service team will conduct a verification process and update you through email.

After successful verification, we will arrange to dispatch your order. It will take 5 – 7 business days for your order to arrive.


PRIVACY

We understands that the information you provide to us is private and confidential and will not pass on any information obtained via the website to third parties. We does not collect information from its visitors without their prior knowledge.

When making any purchase through this website we will ask you for personal information, such as your name, email address, shipping address, etc. This information is only used to process your order, and will not be shared or sold to any other company.


TERMS OF SALE

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majored for which we will not be responsible.


PRODUCT INFORMATION

We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurate reflect the colour of the product on delivery.

All sizes and measurements are approximate; however we do make every effort to ensure they are as accurate as possible. Please refer to the size guide and individual product size for clarification.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.


PURCHASE OF PRODUCT

Our acceptance of your order do not take place until payment is cleared, at which point the contract for the purchase of goods will be made.

Please make sure that everything is correct before clicking the 'CONFIRM & PAY' button.

We reserve the right to refuse an order. Non-acceptance of an order may for example, result from one of the following:

  • The product ordered being unavailable from stock.

  • Our inability to obtain authorization of payment.

  • The identification of an error within the product information, including price or promotion.

  • If we suspect any fraudulent activity.

If there are any problems with your order we shall contact you. We reserve the right to reject any offer to purchase by you at any time. We will take all necessary measures to keep the details of your order and payment secure.

Price are subject to change without notice. These changes will not affect orders that have already been dispatched. 

Goods are subject to availability. As there is a delay between the time when the order is placed and the time when the order is accepted the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out of stock items.

We continually update our websites. From time to time our retail stores may run special local promotions (which may  not be available on our website) or we may offer special discounts online that are not available in our retail stores. Additionally some website promotions may not be available to customers in particular jurisdictions.

RETURNS

All product descriptions, information and materials posted on this Site are provided 'as is' and without warranties express, implied or otherwise howsoever arising.

Once your payment has been confirmed, the sale is final. We cannot accept returns or exchanges unless the item you purchased is proven to be defective, which must be proven by the customer. If you received a faulty/defective products(s), please contact our Customer Service team.


FAULTY/DEFECTIVE PRODUCT(S)

We will replace in accordance with conditions specified below:

  • Incorrect item shipped

  • Incorrectly sized

  • Not described accurately as product photo

  • Faulty/Defective product(s)


Our store procedure is to check items before dispatch to ensure everything is in order and good condition. However, if you find that item delivered to you is faulty or defective, please contact our Customer Service team with :

  • Name

  • Email Address

  • Phone number

  • Date of order

  • Receipt number

  • Reason for return product(s)


REQUIREMENTS FOR A VALID RETURNED PRODUCT(S)

  • Proof of purchased (certification of online order record/receipt)

  • Reason for return has to be valid and return acceptance conditions met


FAULTY PRODUCT(S) -- BEFORE REPLACEMENT

  • Shipping charges for all returns must be paid and insured by you

  • You are responsible for any loss or damage to product(s) during shipment

  • We cannot guarantee that we will receive your returned products(s). Shipping and handling charges are not refundable


Once we received the returned product(s), we will examine and email you in 2 – 3 business days whether you are entitled to a replacement as a result of the defect. Replacement process only begins after we have completed evaluating your returned product(s).

You are entitled replacement if your return meets all requirements. You will receive an email notification stating that we are now processing the replacement for your order.

Please expect to receive your replacement within 7 business days from the date we received the returned item, the post stamp date on your returned parcel.

NOTE: In the unlikely event that your return does not meet requirement(s), our Customer Service Will notify you before sending it back to you. In this instance, your return courier/postal fee will not be reimbursed.



EXCHANGE POLICY

Item is only allowed to be exchanged within 15 days after the received date (Item needs to be in new condition or unworn condition together with the original tags)

If the item needs to be exchanged for a different size, design or colour, we will grant the request for the exchange process for only ONCE .Exchanged item needs to be sent to the main headquarters of Top Fashion located at address as below :

(Note: We will not cover the cost of the courier of the returned items. This cost will need to be borne by customers, however we will ship the exchanged item back to customers for free).For items that needs to be exchanged, customer must include and the invoice/receipt that was issued)

We try our best to deliver goods of acceptable quality so the exchange policy can only be enforced only if the product is faulty upon delivery. We will then inspect the faulty products within reasonable time.To be able to claim remedies for the the faulty products,we may need your help to provide detailed information regarding the faulty product.

We do not do refund policy but in certain circumstances if customers are not happy with the product , the product need to be returned to us.We will refund customers with a store credit consisting of the value of the product

(Note: This store credit can be used to purchase items only from our online store)

Delivery & Cancellation

  • The product will be sent to the shipping address which was provided by customer when the item was placed.

  • Once the product is shipped, we will notify the registered email address with the tracking number.

  • We offer free delivery of all items.


TRANSACTION

To be eligible to purchase from our website, customers must be over 18 and have a debit / credit card issued by a bank that are acceptable by us.If a customer is below 18, the approval of the usage of the debit/credit card holder must be present.You must assure that all the information provided for the transaction be correct.We have the right to validate the payment information before providing you with the product.

If you are asked for details of a card payment,you must be entitled to purchase from the card or account. The card or account must possess sufficient amount to cover the proposed payment.

We hold no responsibility in any fraud or stolen credit cards that are used to purchase a product in our website.

  • Every effort is made to ensure the accuracy of all information and prices but, regrettably, errors such as system error do occasionally occur. Where a price is obviously incorrect due to a system error, we shall not be bound by such price.
